DETROIT (WKZO) -- Former Detroit Mayor Kwame Kilpatrick is looking for a new trial.

Kilpatrick's attorney, Harold Gurewitz, filed the motion on June 28th based on Kilpatrick's inability to have "a choice of a conflict-free counsel."  Prior to his trial, Kilpatrick tried to have his lawyer James Thomas removed, saying the two could not agree on a defense.

Kilpatrick also argued that Thomas represented a man who testified during the conspiracy and racketeering case.  U.S. District Court Judge Nancy Edmunds ruled Kilpatrick should have seen the man's name on the witness list and not signed a waiver approving the list.
